State Employment Laws

State laws provide a number of employment regulations and guidelines that employers in a state must comply with. These laws protect the rights, health and financial remuneration of employees and set out employers’ obligations. Similar to Federal laws, the prime objective of State laws is to protect workers from employment discrimination, on grounds of race, gender, religion, national origin, and age. State laws govern various issues including minimum wage, hours of work, child labor, discrimination, and payment of wages among others.

In general, state laws do not supersede federal labor laws. However, state laws provide some interesting exceptions. For instance, although most states follow the federal minimum wage requirements, some have minimum wage standards that are higher than the federal law. The Department of Labor (DOL) instructs employers to follow the law that provides the highest standard of protection to employees. State laws, therefore, provide the regulatory framework to protect the rights of employees and promote their welfare.
